"INFORMATION CLAUSE - PUBLIC PROCUREMENT"

INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA

Poltrade17 Ltd. based in Warsaw processes data contained in offers or applications to participate in public procurement proceedings, data contained in publicly available registers (National Court Register, Central Registration and Information on Economic Activity of the Republic of Poland, National Criminal Register) to conducting public procurement procedures under the provisions of the Act of September 11, 2019, Public Procurement Law. This information may include data that is according to Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (from now on: "GDPR") are personal data.

II. LEGAL BASIS AND PURPOSES OF PERSONAL DATA PROCESSING
Personal data contained in offers are processed according to Art. 6(1)(a) b and c of the GDPR, i.e., processing is necessary to conclude and perform a public procurement contract and fulfill the Administrator`s legal obligation resulting from the Act of September 11, 2019, and accounting and archiving obligations. The purpose of personal data processing is to conduct public contract procedures.

III. INFORMATION ON THE REQUIREMENT/VOLUNTARINESS OF PROVIDING DATA AND THE CONSEQUENCES OF NOT PROVIDING PERSONAL DATA
Providing your data is a statutory requirement. You are obliged to provide them, and the consequence of not providing personal data will be the inability to evaluate offers and conclude a contract.

IV. RECIPIENTS OF PERSONAL DATA
The recipients of personal data contained in offers will be members of tender committees and authorized employees of the Administrator, as well as entities authorized to obtain personal data under the law.

V. PERSONAL DATA STORAGE PERIOD
Personal data will be stored for 4 years from the contract procedure`s completion date. If the contract duration exceeds 4 years, the storage period covers its entire duration.

VI. RIGHTS OF PERSONS TO WHOM THE DATA CONCERN
In connection with the processing of personal data, you have the right to:
1. Access to your data,
2. Receive a copy of your data,
3. Rectification of personal data,
4. Requests to limit the processing of personal data
– in the cases and under the conditions specified in the GDPR. The rights listed above can be exercised by contacting the Administrator.

VII. THE RIGHT TO SUBMIT A COMPLAINT TO THE SUPERVISORY AUTHORITY
You have the right to complain to the President of the Personal Data Protection Office if:
it is justified that your data is processed by the administrator contrary to GDPR.

VIII. AUTOMATED DECISION MAKING, INCLUDING PROFILING
Your data will not be processed in an automated manner, including in the form of profiling.

IX. TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY OR AN INTERNATIONAL ORGANIZATION
Your data will not be transferred to international organizations or third countries.
